A VCAT appeal against the council’s rejection of a Safeway supermarket in Mt Evelyn is to go ahead.
Residents who are opposing the supermarket have been calling for the appeal to be dismissed after the developer failed to notify a third of the objectors about the hearing.
But VCAT has now ruled that the appeal hearing will go ahead on Monday 12 November.
Mt Evelyn Environment Protection and Progress Association (MEEPA) president Frank Smith said although the residents lost this attempt to have the application ‘thrown-out’ there is still time to lodge objections.
Mr Smith said it was critically important for those people who weren’t notified about the appeal to send their objections to VCAT by Tuesday 25 September.
The proposed development is for a supermarket with five speciality stores plus a two-storey car park on the corner of Snowball Avenue and Station Street.
